Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the PerpDB website at perpdb.xyz, the PerpDB API, WebSocket streams, documentation, and related services (together, the “Service”), operated by PerpDB (“we”, “us”). By accessing or using the Service, or by creating an account, you agree to be bound by these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

PerpDB provides analytics and programmatic access to data about perpetual-futures decentralized exchanges (“perp DEXs”), including trades, positions, liquidations, funding rates, open interest, volume, fees, and related market data. The data is derived from public blockchains and from third-party protocols that we do not operate or control.

3. Accounts and API keys

Some features require an account. You agree to provide accurate account information and to keep it current. API keys are issued to your account and are for your use (or your organization’s use) only: you may not share, sell, or transfer keys, and you are responsible for all activity under your keys. Notify us promptly if you believe a key has been compromised; you can revoke and re-issue keys from your account at any time.

4. Plans, trials, and billing

Paid plans are billed in advance on a recurring subscription basis through our payment processor, Stripe. Subscriptions renew automatically until canceled. Plan limits — request rates, monthly credits, history depth, and streaming access — are described on the plans page and are enforced by the Service.

Where a free trial is offered, a valid payment method is required to start it; the trial converts to a paid subscription at the end of the trial period unless canceled first. Upgrades and downgrades are prorated. Canceling stops future renewals; your plan remains active through the end of the paid period. Except where required by law, fees already paid are non-refundable.

5. Acceptable use

You agree not to:

  • circumvent, or attempt to circumvent, rate limits, quotas, plan gating, or other technical controls, including by rotating accounts, keys, or IP addresses;
  • resell, sublicense, or redistribute the Service or bulk data obtained from it as a substitute for the Service (see §6);
  • use the Service to violate any law or the rights of others;
  • probe, scan, or test the vulnerability of the Service other than through our authorized channels;
  • interfere with the operation of the Service or impose an unreasonable load on our infrastructure.

6. Data license

Subject to these Terms and your plan limits, we grant you a limited, non-exclusive, non-transferable license to access the data made available through the Service and to use it within your organization and in your own products, analyses, and publications. You may publish charts, figures, and excerpts derived from the data with attribution to PerpDB. You may not resell or redistribute raw or bulk data obtained from the Service in a way that substitutes for the Service itself.

7. Data accuracy

We work hard to make the data accurate, and we correct verified errors as quickly as we can. However, the data is derived from third-party protocols and public blockchains that change without notice — protocols upgrade their programs, alter data formats and interfaces, migrate markets, and occasionally emit incorrect data themselves. As a result:

  • the data is provided “as is” and may be delayed, incomplete, or inaccurate;
  • historical data may be revised, backfilled, or corrected after the fact as errors are found and fixed;
  • coverage of any particular protocol, market, or metric may change or end;
  • you are responsible for independently verifying any data before relying on it for any decision.

8. No financial advice

Nothing in the Service is investment, financial, legal, or tax advice, or a recommendation or solicitation to buy, sell, or hold any asset or to use any protocol. Trading perpetual futures involves substantial risk of loss. We are not a broker, advisor, or fiduciary, and we owe you no fiduciary duties. Decisions you make based on data from the Service are yours alone.

9. Availability and changes to the Service

We may change the Service over time, including adding, modifying, or removing endpoints, response fields, retention windows, protocols, and features. Where a change is breaking for API consumers, we make reasonable efforts to provide notice in advance through the documentation or by email. We do not guarantee uninterrupted availability, and the Service may be temporarily unavailable for maintenance or reasons outside our control.

10. Intellectual property

The Service — including its software, design, documentation, branding, and the curated and derived datasets we produce — is owned by us or our licensors. Underlying blockchain data is public; these Terms do not claim ownership over public ledger data, only over the Service and the datasets, aggregations, and interfaces we build from it.

11. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access (including revoking API keys) if you materially breach these Terms — including the acceptable-use and data-license rules — or where necessary to protect the Service or comply with law. Sections 6–8 and 10–14 survive termination.

12. Disclaimer of warranties

THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR TRADING LOSSES, ARISING FROM OR RELATED TO THE SERVICE OR THE DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service in violation of these Terms or of applicable law.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of PerpDB is established, without regard to conflict-of-law rules. Courts of that jurisdiction have exclusive jurisdiction over disputes arising from these Terms, except where applicable law grants you mandatory rights to another venue.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced through the Service or by email, and the “Last updated” date above will change. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
